On March 31, 2009, CSMS #09-000148 was issued describing a number of changes to the Importer Security Filing (ISF) Transaction Sets for ABI and AMS. Based on requests by the trade, the effective date of this change is being delayed until the end of June. The changes will become available in both the Production and the Certification regions upon the effective date, which will be announced approximately one week in advance. Please, see the link below for the new Transaction Sets as well as a list of the specific changes.

Furthermore, as CBP has increased editing of the current Transaction Sets, ISF filers may have noticed an increased number of rejections that were not previously encountered in response to their ISF submissions. While these rejections may not be familiar to the trade at first, they are an appropriate validation of the current Transactions Sets indicating that data is missing or incorrectly submitted.

As the quality of ISF submissions has continued to increase, CBP will implement additional data edits to ISF programming. Please, continue to use diligence in providing appropriate and correct information to CBP. If you have any questions, please contact your Client Representative.

Automated Broker Interface

On May 18, 2009, CBP will begin sending follow-up Status Advisory (SA) messages, as previously described in CSMS #09-000149, to Automated Broker Interface (ABI) ISF filers when a bill of lading (B/L) is submitted that matches to an Importer Security Filing (ISF) already on file with CBP. Similar notifications to Automated Manifest System (AMS) ISF filers will be sent as described below.

When a B/L has matched to an ISF presented in ABI, the filer will receive a SA message. The match information will be in the SA50 record with a Disposition Code of S1 in positions 5-6. The remarks will contain the text message 'BILL ON FILE' in positions 7-46.

When a B/L has matched to an ISF presented in X12 format in AMS, the filer will receive an X12 350 message. The match information will be in the X4 segment with an X407 Disposition Code of S1. The K1 segment will contain the text message 'BILL ON FILE'.

When a B/L has matched to an ISF presented in CAMIR format in AMS, the filer will receive an RC message. The match information will be in the R02 record, with a Disposition Code of S1 in positions 16-17. The R03 record will contain the text 'BILL ON FILE'.

In a similar manner as described above, notifications will be sent to ISF filers 5, 20, and 30 days after the initial ISF filing when no B/L has been filed to match the ISF. These messages will read 'NO BILL ON FILE' and include Disposition Codes S3, S4, or S5. This may be an indication to the filer that the B/L was incorrectly reported in the ISF on file with CBP.

Ocean Manifest

The Security Filing, commonly known as the 10+2 initiative, is a Customs and Border Protection (CBP) regulation that requires importers and vessel operating carriers to provide additional advance trade data to CBP.

Upon the submission of an Importer Security Filing (ISF), CBP attempts to match the House or Regular Bills of Lading provided therein against those submitted in a Manifest filing. Similarly, upon the submission of a Manifest filing, CBP attempts to match the House or Regular Bills of Lading therein against those submitted in Importer Security Filings. This match does not occur for Master Bills of Lading.

When the first successful match occurs, CBP will transmit a status notification message to the issuer of the Bill of Lading (carrier or NVOCC) and all secondary notify parties. The status notification message will be transmitted in CAMIR RC or X.12 350 format (based on the participants established communication syntax), and will contain new disposition code '3Z' and description 'SECURITY FILING ON FILE'. Subsequent matches of ISFs against that manifested Bill of Lading will not result in additional status notification messages containing the 3Z disposition code.

Conversely, if an ISF that was previously matched to a manifested Bill of Lading is deleted by the ISF filer, and there are no other ISFs matched to that Bill of lading, a status notification message will be sent containing new disposition code ‘3U’ and description ‘SECURITY FILING DELETED’. Should a subsequently filed ISF cite that Bill of Lading, a ‘3Z’ status notification will again be issued.

NOTE: These new disposition codes were created at the request of the trade and are for informational purposes only. The issuer of the bill of lading (carrier or NVOCC) will not be provided the actual security filing data elements. Further, the vessel operator, vessel operating carrier and NVOCC are not required by CBP to verify that a security filing has been filed against a bill of lading.

Status notification messages containing these two new disposition codes will be sent to Automated Manifest System filers beginning Wednesday Morning May, 27, 2009, at approximately 09:00 Eastern Daylight Time.

Effective May 22, 2009, the Revenue Division, Office of Finance will no longer post information about continuous bonds scheduled for insufficiency in ACE.

Since February, 2009, the Revenue Division has posted information about continuous bonds scheduled to be rendered insufficient to the surety's BAL (business activity log) in ACE. Per message 09-000069, CBP agreed to evaluate this pilot process for at least 45 days before deciding whether or not to permanently adopt it.

Based on an overall 'success rate' of less than 50%, the Revenue Division, Office of Finance has decided to discontinue this pilot program at this time. Access to ABI has been intermittent today, May 18. The Data Center is aware of the problem and a ticket has been opened and is under processing to restore full access to ABI by the trade. Until full access is restored, filers may experience ongoing interruptions in connections when they attempt to sign on to the VPN. Customs apologizes for any delays caused by the temporary VPN outage.

This message provides information regarding an additional delay in modifications to the action taken by the United States Trade Representative (USTR) in connection with the World Trade Organization settlement proceedings in the European Community (EC)-Beef Hormone dispute.

On May 6, 2009, the United States and the European Commission announced an “agreement in principle” regarding the dispute. The first phase of the agreement provides that the United States will not apply retaliatory duties greater than those currently in effect. In order to allow additional time to complete the procedures of the agreement, the USTR has decided to once again delay the effective date of the additional duties from May 9, 2009 to August 15, 2009 which was published in Federal Register Notice (FRN) dated May 13, 2009.

The net effect of the delays on implementing the modifications is that the following HTS chapter 99, subchapter III, provisions remain in effect:

Truck Manifest

On June 1, 2009 the Western Hemisphere Travel Initiative (WHTI) will go into effect at land and seaports of entry, requiring travelers – including U.S. and Canadian citizens – to present an approved travel document to enter the United States.

WHTI-compliant documents are:

• U.S. or Canadian passports;

• Trusted Traveler Card (NEXUS, SENTRI, or FAST);

• U.S. Passport Card;

• State- or province-issued Enhanced Driver’s Licenses (when and where available);

• Form I-872 American Indian Card, or (when available) enhanced tribal cards;

• Military identification cards presented by members of the U.S. armed forces traveling on official orders; and

• U.S. Merchant Mariner Document (for U.S. citizens, when conducting official maritime business).

WHTI-compliant document rules apply to U.S. and Canadian citizens. All other documentary requirements (visas, etc.) will still remain in place.

As of June 1st carriers filing ACE e-Manifests are required to provide at least one of the following travel documents and country of citizenship when reporting crew and passenger information.

• Enhanced Driver’s License (EDL)

• SENTRI Card

• NEXUS Card

• Passport

• Visa (Non Immigrant)

• Visa (Immigrant)

• Laser Visa (Border Crossing Card)

• Permanent Resident Card (C1)

• NOTE: Although FAST ID Cards are WHTI compliant documents, Portal filers are reminded that FAST drivers are not to be stored in ACE Portal driver accounts. FAST drivers are to be added to the manifest through “Add Crew Member by ID,” selecting “Travel Document” “Fast Card” as the ID type and then entering the FAST Card number.

E-Manifests can be rejected for failure to transmit these required data elements at anytime after June 1, 2009, however the ACE e-Manifest rejection functionality will not be deployed on June 1st as originally planed. It is important to take action regarding any of the following ACE e-Manifest warning messages to insure that your drivers are not delayed at the border as of June 1st or that your e-Manifests are not rejected in the future.

ACE Portal Accounts

Automated Broker Interface

This message is being provided to the trade to introduce and disseminate several documents to assist with processing Automated Commercial Environment (ACE) entry summaries.

> Business Rules and Process Document (Trade) Version 1.1

The Business Rules and Process Document outlines entry summary processing in ACE. The functionality delivered in ESAR A2.2 sets the foundation for a true electronic system of record keeping surrounding entry summary processing. A change of this significance requires revised operational policies and procedures and this document will address those changes. Links to program and policy documents are included, as well.

> ACE Entry Summary Instructions Version 1.1

The ACE Entry Summary Instructions document is similar to the CBP Form 7501 Instructions. It is organized in the manner in which the data is transmitted and stored in ACE. Descriptions of the entry summary data fields and links to program and policy documents are included in the preparation instructions.

> CBP Form 7501 TEST – Document/Payment Transmittal

This “Test” 7501 transmittal may be used by the trade to submit documents requested or monies due related to an ACE entry summary. This document will be identified as a link to the forms site.

> ACE Entry Summary Rejection Response

This response template may be used by the trade to respond to a CBP initiated electronic entry summary rejection. CBP users should not use this form to initiate a manual rejection for ACE entry summaries.

We are currently experiencing a system problem which prevents submitters who filed via ABI/ACS from receiving prior notice confirmation and would prevent CBP from auto-checking the prior notice confirmation for ABI/ACS filers.

If prior notice has not already been submitted, ABI filers may decide to wait out the ACS/OASIS downtime if users determine that the timeliness of prior notice will not be adversely affected. Filers who choose this option should understand they remain responsible under section 801(m) of the Act and under the prior notice interim final rule for filing timely final prior notice.

Alternatively, filers may submit prior notice via PNSI in which case the prior notice confirmation number must accompany the article of food (21 CFR 1.279(g).

If prior notice is submitted through PNSI, FDA and CBP recommend that the submitter present the PSNI confirmation page, including the prior notice confirmation number and time stamp, to CBP officers for cargo release. If the PNSI confirmation page is not presented, this may delay cargo release, while the CBP officer, without being able to access OASIS, contacts FDA for verification of the prior notice confirmation numer(s) and time of submission.

If prior otice has already been submitted via ABI/ACS prior to the interface outage and confirmation has already been received, the submitter may proceed with prior notice using the standard process. If prior notice has already been submitted via ABI/ACS and confirmation has not been received prior to the interface outage, FDA and CBP recommend that rather than resubmitting via PNSI, submitters should provide to CBP officers, at the time of cargo release, an endorsed (signed) copy of the ABI transmission or some other evidence adequate to show that prior notice has been submitted via ABI/ACS.

Upon restoration of the interface FDA intends to provide notice, via web page posting at http://www.cfsan.fda.gov~furls/fisstat.html, that normal processing has resumed.

Ocean Manifest

CBP is publishing this Stow Plan submission guidance to:

1. confirm CBP required data elements for the stow plan,

2. re-affirm currently acceptable submission formats,

3. describe additional data CBP would prefer carriers to provide,

4. decribe the data required for CBP to route messages back to carriers that use third party communications systems to submit stow plans, and

5. again confirm that anticipated ACE edits will reject any stow plan that does not have all the mandatory elements.

CBP system edits enforcing adherence to the data requirements described in the guidance document will become effective upon production deployment of the ACE Multi Modal Manifest application commonly referred to as M1.

Washington – U.S. Customs and Border Protection reminds members of its Free and Secure Trade program that all FAST cards are compliant with the new travel document requirements under the Western Hemisphere Travel Initiative that went into effect on June 1.

FAST cards can be used by travelers in commercial lanes or in regular passenger lanes at U.S. land ports of entry. They cannot be used in the NEXUS and SENTRI dedicated lanes.

CBP has been issuing new cards for current FAST members since March 16. The new cards have enhanced security features that allow U.S. and Canadian citizen cardholders to comply with the documentary requirements under WHTI. All members must activate their cards within 30 days of issuance by going to the GOES application on the CBP Web site:

FAST members are requested to destroy their old cards after activating their new ones and to verify and update their contact information online.

CBP will notify FAST members when their old cards will be deactivated.

FAST members who have not yet received their new cards should call the enrollment center where they joined the FAST program to schedule a time to pick up their new card in the next 30 days.

Washington – La Oficina de Protección Aduanera y de Fronteras de los Estados Unidos les recuerda a los miembros del programa de Comercio Libre y Seguro que todas las tarjetas FAST son parte de los nuevos requisitos de documento de viaje bajo la Iniciativa de Viaje del Hemisferio Occidental (WHTI) que entró en vigor el 1 de junio.

La tarjeta FAST puede ser utilizada por viajeros en sendas comerciales o en sendas regulares de pasajero en puertos de entrada de los Estados Unidos. Ellos no pueden utilizar las senda dedicas de NEXUS y SENTRI.

La CBP ha estado emitiendo nuevas tarjetas FAST para los miembros actuales desde marzo 16. Las nuevas tarjetas contienen realces en las características de seguridad que permiten a los portadores ciudadanos de Estados Unidos y Canadá a obedecer con los requisitos documentales bajo WHTI. On March 31, 2009, CSMS #09-000148 was issued describing a number of changes to the Importer

Security Filing (ISF) Transaction Sets for ABI and AMS. A follow-up CSMS message #09-000175 was issued on April 13, 2009 which included further changes.

These 'pending transaction sets,' which can be found at the link below, will become effective on July 1, 2009. The changes will be implemented during the scheduled ACS maintenance outage (between 05:00 and 07:00am) and will be available in both the Production and the Certification (ProdCert) regions.

On June 19, 2009, CSMS #09-000249 was issued announcing that pending changes to the Importer Security Filing (ISF) Transaction Sets for ABI and AMS will be implemented on July 1, 2009. Those changes will NOT be implemented on July 1; instead, they will be implemented on Sunday morning July 12, 2009 during the scheduled ACS maintenance window that extends to 03:00am Eastern Time. Again, the changes will become available in both the Production and the Certification regions at the conclusion of that maintenance window.

The changes recently completed include:

1. Modifications made as a result of the 484(f) Committee, the Committee for Statistical Annotation of Tariff Schedules. These changes are effective on July 1, 2009.

2. Changes were also made as required by the verification of the 2009 Harmonized Tariff Schedule (HTS). We will continue to verify the 2009 HTS for the remainder of the year.

3. The updated records are currently available to all ABI participants and can be retrieved electronically via the procedures indicated in the CATAIR. Automated Broker Interface

The CAFES application that generates a modified CBP Form 7512 with 2 Dimensional bar code (PDF-417) and used for non automated In-Bond initiation at some land border and other locations, will be retired from the CBP automated operations environment when the modernized ocean/rail application, known as the ACE “M1” project, goes into production during CBP Fiscal Year 2010. Current forecast is that M1 will be operationally ready for production deployment around the end of calendar 2009 (FY2010). Further updates will be provided as the M1 project nears production implementation.

All CAFES users should begin preparing to use alternate means of In-Bond initiation, such as the automated “QP-WP” application set. For information regarding QP-WP, please contact your assigned client representative.

The CAFES application that generates a modified CBP Form 7512 with 2 Dimensional bar code (PDF-417) and used for non automated In-Bond initiation at some land border and other locations, will be retired from the CBP automated operations environment when the modernized ocean/rail application, known as the ACE “M1” project, goes into production during CBP Fiscal Year 2010. Current forecast is that M1 will be operationally ready for production deployment around the end of calendar 2009 (FY2010). Further updates will be provided as the M1 project nears production implementation.

All CAFES users should begin preparing to use alternate means of In-Bond initiation, such as the automated “QP-WP” application set. For information regarding QP-WP, please contact your assigned client representative.

ACE Portal Accounts

There are changes to the duty-free treatment of certain articles under the GSP program. (See Presidential Proclamation 8394, dated June 29, 2009, and published in the Federal Register on July 2, 2009 (Vol. 74, No. 126)). These changes are effective with respect to goods entered, or withdrawn from warehouse, on of after July 1, 2009.

The following products are now eligible for GSP preference from all GSP-eligible countries and not only from Lesser-Developed Beneficiary Developing Countries (LDBDCs):

0710.10.00 frozen uncooked potatoes

0710.30.00 frozen spinach

Therefore, frozen uncooked potatoes properly classified under 0710.10.00, HTS and frozen spinach, properly classified under 0710.30.00, HTS originating in any GSP-eligible country are eligible for GSP preference.

The following product/country combinations are no longer eligible for GSP preference, as the President has determined that they are sufficiently competitive in the U.S. market and no longer need GSP treatment:

1604.15.00 prepared or preserved mackerel Thailand

2804.29.00 rare gases, other than argon Ukraine

2819.10.00 Chromium Trioxide Turkey

2918.99.30 Aromatic drugs derived from carboxylic acids India

Subject: Changes to the 2009 Harmonized Tariff Schedule

The changes recently completed include:

1. Modifications made as a result of Presidential Proclamation 8394, To Modify Duty-Free Treatment under the Generalized System of Preferences. These changes are effective on July 1, 2009.

2. Adjustments to cotton assessments mandated by the Agricultural Marketing Service (AMS). These adjustments are effective August 7, 2009.

3. Changes were also made as required by the verification of the 2009 Harmonized Tariff Schedule (HTS). We will continue to verify the 2009 HTS for the remainder of the year.

4. The updated records are currently available to all ABI participants and can be retrieved electronically via the procedures indicated in the CATAIR. Automated Broker Interface

On July 12, 2009, CBP implemented a number of changes to the Importer Security Filing (ISF) processing. At that time, the transaction sets on the Security Filing page were updated to reflect these changes. Two changes are described below for your reference.

CBP has corrected errors to the ANSI X12 309 Importer Security Filing document, as well as added and/or clarified many of the descriptions and explanations within this document. The major changes to this document are listed below, but please review the revised descriptions for greater clarity on what CBP is requiring. This updated document has been posted to the CBP website.

1. Qualifier CIN was removed from REF01 at position 0310

2. Acceptable values for BIN and BIC have been added to REF04

3. Qualifier 24 was added back to N103 at position 1000 to report an IRS#

4. Qualifier EI in N103 at position 1585 was replaced with 24

Along with the transaction set changes that were implemented, CBP has continued to add data edits to ISF programming as mentioned in CSMS #09-000220. These validations help to ensure that CBP is receiving appropriate information in ISF transactions. The following edits were implemented as warnings on July 12, 2009, but will become fatal errors on August 15, 2009. Please, ensure that your transactions include the appropriate data as necessary.

1. Edit for missing Importer of Record

a. CATAIR / CAMIR - Error Code 302, Error Message 'Importer Required'

b. X.12 – Error Message '485 NM1 Missing Importer'

2. Edit for incorrect Action Reason Code

a. CATAIR / CAMIR – Error Code 132, Error Message 'Invalid Action Reason Code'

U.S. Customs and Border Protection has discovered an issue with Aggregate and Detail Cargo Entry reports whereby those reports are not returning any data. Additional reports which are impacted by the issue include Account Management Entry Summary reports and the ACE Entry Summary reports. Entry Summary reports contain complete data through mid-Monday, July 27, 2009. Account Management Entry Summary reports and ACE Entry Summary reports will not be complete until Saturday, August 1, 2009. Cargo Entry reports will be complete on Saturday as well. This issue is being addressed as quickly as possible. A new message will be posted to the ACE News portal as soon as all reports are complete.
